EQUIPE DE FIBRA APPLICATION

The Terms of Use of the Equipe de Fibra application, a project from Unidos pela Vida - Around the World for Cystic Fibrosis are described below. All User relations and interactions with this platform are carried out digitally and online.

To use the platform, Users download the application from the online store on their smartphones, provide the personal data requested (whose use and storage are detailed described in our Privacy Policy), and create a personal password, that is confidential and non-transferable. Users shall not, under any circumstances, disclose this password to third parties and are sole responsible for the unauthorized use of the password registered.

All user information are confidential, and may only be used for the purposes of this platform. The acceptance of these Terms authorizes access to this information by Unidos pela Vida Institute. Only Users over 18 years of age, are entitled to use the platform.

1. FIRST INFORMATION

‍The digital platform "Equipe de Fibra Application", was developed by Unidos pela Vida Institute, a non-profit organization headquartered in the city of Curitiba / Paraná, at Rua Francisco Rocha, number 198, in Curitiba - PR, CEP 80420-130, registered in the CNPJ under no. 14.855.350/0001-84.

By downloading our app and using our services, you agree to these Terms of Use. Your agreement includes both Terms of Use and our Privacy Policy, and by using our Services, you confirm that you have read, understood, and are in accordance with the terms set forth therein, committing to complying with them in full.

To use the platform, Users must: (i) be 18 (eighteen) years of age or older; (ii) be able to enter into a binding contract and not be prevented from doing so in accordance with applicable laws; (iii) have a smartphone with iOS version xx or newer or Android version yy or newer, with broadband internet access (3G or 4G).

Users also confirm that all registration information submitted are true, accurate, and complete, being aware that any incompatibility will prevent the platform / application from working, without any liability for Unidos pela Vida Institute.

2. DEFINITIONS

‍For the purposes of these Terms and Conditions of Use, the following expressions are defined:

User(s): individual, of legal age, with full capacity to make his/her personal registration in order to take advantage of the functionalities offered by the platform / application, in this opportunity, accepting unconditionally these Terms of Use and the Privacy Policy.

Equipe de Fibra Platform/Application: application developed by Unidos pela Vida Institute for smartphones featuring IOS or Android operating systems, in minimal versions and with broadband internet access (3G or 4G).

Equipe de Fibra is a project of Unidos pela Vida Institute, a non-profit organization headquartered in the city of Curitiba / Paraná, at Rua Francisco Rocha, number 198, in Curitiba - PR, CEP 80420-130, registered in the CNPJ under no. 14.855.350/0001-84.

Personal Data: means any and all data input by Users that, in any way, identifies them, such as, name, telephone number, email, or any other information available in detail in our Privacy Policy.

Service(s): All services available to Users on the platform.

Terms of Use: These Terms apply to all actions taken through the Around the World for Cystic Fibrosis platform.

Privacy Policy: Means the privacy policy that rules on the use of User data, which can be found at the following link: https://voltaaomundofc.org.br/en/politica-privacidade.

Accept or Acceptance: he action of clicking on the box "I have read and accept the Terms of Use and Privacy Policy", as well as in the box arranged on the platform/ application. Such act implies prior, express and informed consent of the User in relation to all provisions of such documents, authorizing the storage on a database including Personal Data, among other information.

3. UNDERSTANDING THE PLATFORM

The Equipe de Fibra app is a physical activity management application that works by using your location information to calculate the distance of the route traveled during your activity. With this, it captures the distance covered in the activity and the time it took to complete. The application uses the data to register the activities that was performed by your User, ranking it by users, cities and countries. Workouts are also stored in your schedule, so that users can consult the workouts performed. At the end of each workout, Users can take and save photos from the day’s training, which are available in the users’ photo galleries in the app, and can be used in the Around the World for Cystic Fibrosis challenge website.

4. ON THE USE OF THE PLATFORM

4.1. Unidos pela Vida Institute, through these Terms of Use, grants Users a personal, limited, temporary, worldwide, revocable, non-exclusive, and non-transferable license to use the platform/application, free of charge of any kind for Users (only the payment for registration in the Around the World for Cystic Fibrosis challenge), being clear and accepted that Users may not use or allow the use of the platform for any other purpose not expressly provided for in these Terms of Use. In this sense, Users will not be allowed, without any limitation and in any way, to copy, modify, distribute, sell, rent, share or assign the services made available by Unidos pela Vida, through this application

4.2. At the time of registration on the platform, Users will provide their Personal Data, creating a confidential password that is the sole responsibility of each User.

4.2.1. Users will be responsible for the veracity, validity and accuracy of the Personal Data provided by them in their registration, and will be responsible for keeping this registry always up to date.

4.2.2. Unidos pela Vida Institute shall not be obliged to police or supervise the Personal Data provided by users, but may, at its sole discretion, exclude information that seems untrue or excessive.

4.3. The use of the platform is personal and non-transferable and is authorized solely for lawful purposes related to the application, in accordance with these Terms of Use. The intellectual property of the platform belongs to, and shall remain, exclusively to Unidos pela Vida Institute.

4.4. Considering that after the end of the challenge, the application will remain active, if users wish to delete data registered for the challenge hosted within this application, this may be requested at any time, as detailed in our Privacy Policy, through email contato@unidospelavida.org.br or via WhatsApp at +55 41 99636-9493.

5. ON THE REGISTRATION AMOUNT IN THE AROUND THE WORLD FOR CYSTIC FIBROSIS CHALLENGE

From July 23, 2021 to November 22, 2021, the Equipe de Fibra app will host the Around the World for Cystic Fibrosis challenge. During this period, using the application will require payment for the registration in the challenge. All fees will be used for projects of Unidos pela Vida Institute, such as the Equipe de Fibra. 6. ON COMMUNICATION

7. ON INTELLECTUAL PROPERTY

7.1. Through these Terms of Use or the Privacy Policy, Users do not acquire any intellectual property rights or other exclusive rights, including patents, designs, trademarks, copyrights or rights to confidential information or business secrets, about or related to the application, as well as the database comprising user data, all of which are exclusive property of Unidos pela Vida Institute.

7.2. Any and all content made available on the platform/application, as well as any and all databases established belong exclusively to Unidos pela Vida Institute and are protected by Brazilian law, in particular regarding intellectual property and copyright. As the owner of the intellectual property of the aforementioned database, Unidos pela Vida Institute may use it freely and in ways that best meet its interests.

7.3. Unidos pela Vida Institute may, at its sole discretion, at any time and without prior communication to the User: (i) terminate, modify or suspend, in whole or in part, the User's access to the platform/application, when such access or registration violates the conditions set forth in these Terms of Use and/or the Privacy Policy; (ii) exclude, in whole or in part, information registered by the User that is not in line with the provisions contained in these Terms of Use;

7.4. Unidos pela Vida Institute may also, at its sole discretion, suspend, modify or terminate the activities of the platform, upon prior communication to Users, except in case of disasters (natural or otherwise).

7.5. Users hereby authorize Unidos pela Vida Institute to send messages or other correspondences of an informative, commercial and/or promotional nature to the e-mail registered.

8. ON CONFIDENTIAL INFORMATION AND PRIVACY POLICY

8.1. By registering on the platform, Users agree to the Privacy Policy: https://voltaaomundofc.org.br/en/politica-privacidade. By Accepting the Privacy Policy, Users grant Unidos pela Vida Institute authorization to use their data, in accordance with the rules contained in these Terms of Use and the Privacy Policy.

8.2. By issuing their "agreement" at the moment of registration, Users authorize disclosure, sharing and exchange of their information with the third parties described in detail in our privacy policy, contracted for the purpose of developing, storing and hosting this application, for registration and analysis purposes.

8.3. The Equipe de Fibra application stores and processes the personal data provided by Users in order to provide the Service. It is the Users’ responsibility to keep the mobile device and access to the application secure. Users are prohibited from doing jailbreak or root (software restrictions and limitations processes imposed by the official operating system of their device), as this may make the device vulnerable to malware/virus/malicious programs, compromise the security features of the device, and prevent the Equipe de Fibra application from working properly.

9. INDEMNITIES

9.1. In no event shall Unidos pela Vida Institute be liable for personal injury or any incidental, direct, indirect or consequential injury, corruption or loss of data, failure to transmit or receive data, non-business continuity or any other commercial loss or losses, stemming from or in connection with the delivery of services by third parties.

9.2. Users should be aware that there are certain situations for which Unidos pela Vida Institute is not responsible. Certain application functions will require the application to have an active Internet connection. The connection may be Wi-Fi, or provided by your mobile network provider, but Unidos pela Vida Institute cannot be held responsible for the application not working in all of its functions if the User does not have access to Wi-Fi and any part of its remaining data quota.

9.3. If Users are outside an area with Wi-Fi, the terms of the contract with their mobile network provider still apply. As a result, Users may be charged by their mobile operator for the cost of the data during the connection when accessing the application, or any other third-party charges applicable. By using the app, Users accept responsibility for any charges, including data roaming charges, if the app is used outside their territory coverage (i.e., region or country) without turning off data roaming. If the Users are not the payers for the use of the devices on which they are using the app, they must attest to having received permission from the payer to use the app.

10. VALIDITY AND TERMINATION

10.1. These Terms of Use and the Privacy Policy will apply as per item 5 of these Terms, from the User's Acceptance, and may be modified or unilaterally terminated by either party at any time, without any charge, through simple communication through the platform itself or message to the e-mail indicated in the User's personal register and in item 4.4 of these Terms.

‍10.2. Users may, at any time, request the exclusion of the platform, terminating their relationship with Unidos pela Vida Institute, upon request made directly through the platform or other available communication channels as per item 4.4 of these Terms. In this case, the Users’ data will be treated in accordance with the provisions of the Privacy Policy.

11. MODIFICATIONS

11.1. Unidos pela Vida Institute may, at any time, amend these Terms of Use or the Privacy Policy at its sole discretion. Any changes to these Terms of Use and the Privacy Policy will be informed through the platform/application within 24 (twenty-four) hours counted from the actual date of modification.

‍11.2. The date of the latest update to these Terms of Use will always be indicated.

‍11.3. Users acknowledge and accept that, as soon as the amendment to these Terms of Use and/or Privacy Policy is published on the website or on the platform/application, the use thereof will be submitted to the updated Terms of Use/Privacy Policy.

12. GENERAL PROVISIONS

12.1. If any provision of these Terms of Use or Privacy Policy is found to be illegal, void or unenforceable for any reason, the remaining provisions will not be affected, remaining valid and applicable to the fullest extent possible.

‍12.2. These Terms of Use and the Privacy Policy constitute the entire agreement on the terms of use of the Equipe de Fibra application. Users declare being aware of the rights and obligations arising from these Terms of Use and the Privacy Policy, having read, understood and accepted all the terms and conditions contained in them.
